This Terms of Service Agreement (“Agreement”) is a legally binding contract between you (“Customer”, “you”, or “your”) and Wander Where Trips (“Company”, “we”, “us”, or “our”).

This Agreement governs your access to and use of our services, including our website https://www.wanderwheretrips.com/ and any trip itineraries or packages we provide (the “Services”).

IMPORTANT NOTICE

By purchasing a Trip Package or using our Services, you:

  • Confirm that you have read and understood this Agreement
  • Agree to be legally bound by its terms
  • Confirm that you are at least 18 years old or have legal capacity under applicable law

If you do not agree to these Terms, you must not use our Services.

Nothing in these Terms affects your mandatory rights under applicable consumer protection laws.

1. Definitions
  • “Customer” means you and any person using the Services or participating in a Trip Package purchased by you.
  • “Services” means the travel guides, itineraries, recommendations, and related content provided by us.
  • “Trip Packages” means curated itineraries, recommendations, maps, and related materials provided as part of the Services.
  • “Documentation” means any written or digital materials provided to you.
  • “Third-Party Services” means any services, locations, products, or experiences provided by third parties (e.g., restaurants, hotels, attractions).
  • “Company IP” means all intellectual property rights in our Services and content.
2. Access and Use
2.1 Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial use.

2.2 Restrictions

You agree not to:

  • Copy, reproduce, or distribute our content without permission
  • Resell or commercially exploit the Services
  • Modify or create derivative works
  • Use the Services in any unlawful manner

All rights not expressly granted are reserved

3. Nature of the Services

Any bookings or purchases you make with third parties are separate contracts between you and those providers.

4. Customer Responsibilities
4.1 Travel Risks

You acknowledge that travel involves inherent risks. You are responsible for:

  • Your own safety and decisions
  • Complying with all applicable laws and regulations
  • Ensuring you are fit and able to participate in activities
4.2 Third-Party Services

All third-party services are used at your own risk and are subject to their own terms and conditions.

4.3 Conditions & Safety

You are responsible for assessing:

  • Weather conditions
  • Safety of locations and activities
  • Suitability of recommendations
5. Fees and Payment

All prices are displayed at the time of purchase.

Where applicable:

  • Prices will include VAT as required under EU law
  • Payment must be made in full at the time of purchase

You are entitled to receive clear pricing before purchase in accordance with EU consumer law.

6. Consumer Rights (EU Customers)

If you are a consumer residing in the European Union, you may have a legal right of withdrawal within 14 days under the Consumer Rights Directive.

However, this right may be waived if:

  • The digital content (Trip Package) is delivered immediately, and
  • You expressly consent to immediate performance and acknowledge that you lose your right of withdrawal
7. Privacy

We process your personal data in accordance with our Privacy Policy and the General Data Protection Regulation.

By using our Services, you acknowledge that you have read our Privacy Policy.

8. Intellectual Property

All content provided through the Services is owned by us or licensed to us and is protected by intellectual property laws.

You may not use our content except as permitted under this Agreement.

9. Disclaimer of Liability

To the maximum extent permitted by law:

  • The Services are provided “as is” and “as available”
  • We do not guarantee accuracy, completeness, or availability
  • We are not responsible for third-party services or experiences

Nothing in this Agreement excludes liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Your statutory consumer rights
10. Limitation of Liability

To the extent permitted by applicable law:

  • We are not liable for indirect or consequential losses
  • Our total liability shall not exceed the amount you paid for the Services

This limitation does not apply where prohibited under EU or Portuguese law.

11. Indemnification

You agree to indemnify us for losses arising from:

  • Your misuse of the Services
  • Your breach of these Terms
  • Your violation of applicable law

This clause applies only to the extent permitted by applicable law.

13. Governing Law

This Agreement is governed by the laws of Portugal.

If you are a consumer residing in another EU country, you will also benefit from any mandatory protections under the laws of your country of residence.

In the event of a dispute, you may contact us first.

You also have the right to access alternative dispute resolution (ADR) mechanisms in the EU, including:

  • The European Online Dispute Resolution Platform
  • Portuguese consumer arbitration centres
15. Miscellaneous
  • This Agreement constitutes the entire agreement between you and us
  • If any provision is invalid, the remainder remains in effect
  • We may assign this Agreement; you may not without consent
